This Purchase Agreement with Beconnected Tech SL (hereinafter “beconnected”) sets out the conditions under which we will deliver the goods and provide the services offered on the website www.beconnected.com.es (hereinafter "beconnected web") or the APP published on Google Play or Play Store (hereinafter “ beconnected App). This Purchase Agreement is a contract between you and beconnected.
1. Scope of the Agreement
The terms and conditions of this contract between us include the terms on which you agree to purchase our products and services published on the beconnected website or app.
The customer must read these Terms and Conditions carefully since once the purchase has been made, he or she accepts everything established in this agreement.
These conditions tell you who we are, how we will provide you with the Products, how you and we can change or end the Contract, what to do if there is a problem and other important information. If you think there is an error in these conditions or you need any changes, please contact us to discuss it.
This agreement applies to end-consumer customers, companies, organizations and public entities, and may only be used by those customers who are authorized to do so. be different through an agreement and/or private document signed between beconnected and the user/client entity.
Beconnected offers the following products and/or services:
Those delivered may vary aesthetically from those displayed on our website or promotional communications. This is due to stock availability or obsolescence of the technological equipment. This variation will be for a product with similar characteristics or performance or superior. However, once you receive the product, you can always contact beconnected for any queries.
2. PRODUCTS AND SERVICES - SALE
2.1. - PORTABLE WIFI
a. The purchase of the beconnected Wifi Portable device will be made through the website according to the prices published there and the completion of said purchase commits to the total acceptance of this agreement.
b. The portable wifi device will have a 3 (three) month warranty for malfunction or factory damage. This warranty does not cover damage or malfunction resulting from poor handling, impacts, humidity, immersion, heat or any improper use of the device that directly or indirectly affects it.
c. The device itself will not be active until the customer additionally contracts gigabyte plans/packages available on the beconnected website or in the beconnected app. When said plans/packages expire due to capacity or term (whichever occurs first) the portable wifi will stop working until the user/customer recharges again.
d. beconnected will make available to customers the necessary channels for contracting gigabyte packages, namely:
1. beconnected app
2. Web beconnected
e. beconnected will offer an international coverage device (see on the beconnected website or app the countries enabled for the service is the user's responsibility) which for its operation must contract the gigabyte plans/packages for the portable wifi device available on the website or in the app according to the destinations selected by the client.
f. beconnected may NOT accept your order for products or services without the right to claim by the user. If we cannot accept your order, we will inform you of this and we will not charge you for the Product. In the event that for any reason the payment has been made, the amount paid will be refunded by the same means. This NON-acceptance of the purchase may be due to the Product being out of stock, technical problems, our resources being unexpectedly limited and we cannot reasonably foresee it, or we have detected a problem with the Product or the Product being sold out.
2.2. eSIM
a. The purchase of the beconnected eSIM/electronic SIM will be made through the beconnected app/beconnected web according to the prices published there and the completion of said purchase commits to the total acceptance of this agreement.
beconnected will make available to customers the necessary channels for the contracting of gigabyte packages, namely:
1. beconnected App
2. beconnected Web
b. It is the user/customer's absolute responsibility to verify in advance that the device on which the esim/electronic sim will be installed is compatible with the esim/electronic sim service.
On the beconnected website/app you can find the "reference" list of devices compatible with the service, but since said compatibility will depend on the version, year, region and country of manufacture and/or marketing of the device, it is recommended to consult directly with the manufacturer of the device to confirm its compatibility, exempting beconnected from any claim for differences or incompatibilities with the reference list.
c. The esim/electronic sim will have a validity of operation of coverage of countries (see on the beconnected website/app the countries enabled for the service is the responsibility of the user) time and/or capacity, which is informed at the time of purchase. If either of the two operating values is exceeded, the service will be disabled and the user must contract another eSIM/electronic SIM through the beconnected website/app. In the same sense, if the user decides to go to a country/region outside of those indicated in the contracted coverage of the package, the eSIM/electronic SIM will NOT work without this enabling any claims by the user to beconnected.
3. Shipping policy.
Portable Wifi
beconnected will send The product will be sent by third-party mail according to the most convenient times and destinations.
Delivery times will be established on the website and will depend on the destinations, accessibility to the address, prevailing weather, and any foreseen or unforeseen contingency to access the delivery destination. These deadlines will be on the beconnected website and are estimates. In the event that these deadlines are not met and the customer presents their disagreement, they may cancel the purchase and request a refund of all amounts paid to beconnected.
The product will be sent within the packaging/packaging required by the courier contracted by beconnected, so that it reaches the customer in time and form.
In cases where it is provided to us by the courier, it will be sent to the customer in the following manner: The customer will be provided with a tracking number to track their order from beconnected to the destination address.
The shipment guarantees that the customer will receive the product in perfect condition of material and operation. If this is not the case, the customer must contact beconnected within 24 business hours of receipt to make the corresponding claim and receive appropriate advice in case it warrants the exchange of the product free of charge.
In the event that there is no one at the time of delivery to the address, with a previously agreed appointment or with tracking, beconnected is not responsible for or assumes additional costs for subsequent delivery attempts if there are any. These additional costs will be borne by the customer without any right to claim.
eSIM
beconnected will send the electronic esim/sim in digital format by the means enabled at the time of purchase.
The buyer will receive the electronic esim/sim in barcode, QR code or alphanumeric code format to be installed on their device.
It is the responsibility of the user/customer to verify in advance that their device is compatible with the electronic esim/sim service.
Once the electronic esim/sim is installed on the device, the service will be considered received and accepted for activation on the device.
FINAL
The parties agree that any dispute or claim arising from or in relation to the electronic esim/sim service will be resolved by the parties.Any dispute concerning this Agreement or its formation, interpretation, breach, performance or termination shall be settled exclusively by arbitration in Madrid, Spain. The arbitration shall be conducted in accordance with the arbitration rules of the International Chamber of Commerce by a single arbitrator appointed in accordance with said rules. The language of the arbitration shall be Spanish and in the event of requiring translation into another language, the additional costs incurred shall be borne by the applicant in full.
